Barry has concentrated his law practice in the areas of estate planning, estate administration, and elder law. He assists clients in all phases of the administration of estates in both New Jersey and Florida, and he has represented estates in tax disputes with the Internal Revenue Service and state taxing authorities. Barry represents fiduciaries and beneficiaries in probate litigation matters involving settlement of estates and trusts. He also represents alleged incapacitated persons or family members in guardianship proceedings. Barry annually prepares Wills, Trusts, and other documents related to wealth transfer and surrogate decision making, including Durable General Powers of Attorney, Advance Directives for Health Care, and Advance Directives for Mental Health Care. Barry also assists clients in connection with Special Needs Trust planning and preserving elgibility for governmental benefits. He also assists clients in analyzing employment contracts and employment termination agreements, as well as in making employee benefit/retirement decisions, including required minimum distribution planning (as to beneficiary designations). Barry further aids clients with their Medicaid planning, and application for Medicaid eligibility. Barry also advises clients on setting up business entities and providing for the orderly and tax advantageous transfer of their business ownership interests. Barry also assists clients in charitable planning (including the use of Charitable Remainder Trusts, and private foundations).
After serving a judicial clerkship in 1980, Barry spent three years practicing trusts and estate law with Shanley & Fisher in their Morristown, New Jersey office. From September, 1983, through June, 1987, he served as a senior financial counselor with Asset Management Group and The Bank of New York where he worked with high net worth individuals and corporate executives at numerous companies, including Reichhold Chemicals, Bristol Myers, American Brands, Dun & Bradstreet, Schering-Plough, Mack Trucks, AT&T, and Bell of Pennsylvania. In March, 1993, after practicing six years in the Trusts and Estates Department of Drinker Biddle & Reath in their Princeton, New Jersey, office, Barry left and opened his own law firm as a sole practitioner with his primary office in Belle Mead, New Jersey and a second office in Cranford, New Jersey.
Barry has often lectured on the subjects of estate planning, elder law, long term care, and probate to corporate, professional and elder groups. He has also appeared on the radio to answer listener questions regarding Living Wills, probate and estate planning.
Barry is a member of the New Jersey Bar and Florida Bar.
In 1973, Barry received a B.S. degree from Cornell University. In 1974, he earned an M.B.A. from the Syracuse University School of Management, where he was invited to become a member of Beta Sigma Phi, a national business honorary fraternity. In 1977, Barry received a J.D. from the University of Miami School of Law, where he received the American Jurisprudence Award in Contracts. In 1979, Barry received his Masters of Law in Estate Planning from the University of Miami School of Law.
